1. Acknowledgment of Inherent
I, the undersigned participant (or parent/legal guardian of a minor), understand and acknowledge that horseback riding and related equine activities involve inherent risks, including but not limited to:

- Unpredictable behavior of horses, regardless of training or handling
- Uneven terrain, obstacles, or environmental conditions
- Weather-related risks
- Falls, collisions, bites, kicks, and other animal-related incidents
- Equipment failure or human error

Under Utah Code § 78B-4-201 to § 78B-4-203, I recognize and accept these inherent risks and voluntarily assume all such risks as a condition of participation with Riders of the Mark.

2. Release of Liability
In consideration of being permitted to participate in activities conducted by Riders of the Mark, I hereby release, discharge, and hold harmless the following:

- Riders of the Mark
- Its owners, employees, agents, volunteers, instructors, and representatives
- Property owners where the activities take place

from any and all claims or liabilities for injury (including death), loss, or damage to person or property that may result from ordinary negligence, participation, or observation of equine activities. This release does not apply to acts of gross negligence or willful misconduct.

3. Indemnification Agreement
I agree to indemnify and hold harmless Riders of the Mark and its affiliates for any claims, demands, or causes of action brought against them by others due to my actions or participation.

4. Medical Authorization
If emergency medical care is needed, I authorize Riders of the Mark to act on my (or my child’s) behalf. I assume full responsibility for all medical and related expenses incurred.

5. Helmet Acknowledgment

I understand the importance of wearing an ASTM/SEI-certified riding helmet while mounted. I choose to decline a helmet and accept all associated risks. (Available only for adults 18+.)

6. Minor Participant Consent
I am the parent or legal guardian of the minor named above and consent to their participation in equine activities with Riders of the Mark. I accept all terms of this waiver on behalf of myself and my child and confirm that I have explained the risks to my child.

7. Governing Law
This agreement is governed by the laws of the State of Utah. If any portion is held invalid, the remainder shall remain in full effect.
